The "PASS" Program (Providing All Shooters a Shot)

Please select which teams you would like to receive your ASEC Player Profile and DVD from The Ashe Sports PASS (“Providing All Shooters a Shot”) Program. There is a NON-REFUNDABLE $100.00 (USD) fee for each TEAM SELECTED by each player to participate.

Once you have identified the teams (minimum of 3) you wish to contact on the PASS Team Menu,
please mail the following items:

(1) the completed PASS Team Menu,

(2) your completed ASEC Player Profile,

(3) one DVD for each team selected, and

(4) the appropriate fee (using a "bank certified check or money order in US currency"
made payable to ASHE SPORTS, INC) to the following address:

Remember:

The teams are aware that ASHE SPORTS, INC is not responsible for the quality of the game film or its duplication, but team officials have requested that Ashe Sports, Inc encourage all players to produce clear footage of at least one full game from college or professional competition, and to make sure the player's name, jersey number, date of the game(s), and names of the teams playing are all prominently marked on the front of the DVD.
DVDs OF "PICKUP" GAMES OR GAME FOOTAGE THAT IS MORE THAN TWO YEARS OLD MAY BE REJECTED BY THE TEAMS, AND NO REFUNDS WILL BE GIVEN BY ASHE SPORTS, INC.
Also, PASS Program fees paid using cash or personal checks will not be accepted by Ashe Sports, Inc.

Terms and Conditions I. Nature of the Relationship. a. Participating in the PASS (“Providing All Shooters a Shot”) Program does not automatically establish an agency contractual relationship between ASEC and Player. ASEC’s responsibility is limited to delivering a DVD produced by the Player and an ASEC Player Profile to each team selected by the Player on his PASS Team Menu. ASEC does not promise that any team will offer a contract to Player or even respond to the mailing if not interested in Player’s Profile. However, if the PASS Program leads to a contract offer from a team, ASEC expects the Player to sign a representation agreement with ASEC upon receipt of said contract offer, thereby hiring ASEC to negotiate Player’s contract terms and instructing said team to pay the associated agent fee directly to ASEC. b. It is the responsibility of Player to provide the game footage that will be sent to the teams. If Player is unsure about which countries or teams to target, ASEC will make suggestions based on Player’s Profile. II. Other Agents a. By accepting these terms, Player acknowledges that he is not represented by any other Agent domestically and abroad, and that Ashe Sports, Inc has NOT interfered with such a relationship if it is deemed to have existed. b. Player agrees to indemnify and hold ASEC harmless from any and all claims, cause of actions, damages, or debts, including legal fees, resulting from any legal action by another Agent who claims to represent said Player, or from any legal action that results from this program as a result of Player’s negligence or misrepresentations. III. Costs and Expenses a. The fee for this program covers an administration fee, all of Ashe Sports’ costs associated with communicating with teams around the world selected by the Player, and the shipment of video footage to those select teams along with the Player’s Profile. The fee is on a per team basis. Player acknowledges that any other “Player Expenses” related to this program not covered by the teams, including but not limited to, additional footage requested by teams, travel, and the Player’s communication with teams, shall be the Player’s financial responsibility. IV. Consent to Release Information a. Player gives ASEC permission to share his information provided on the ASEC Player Profile with team and league officials domestically and abroad.
